New Install Warranty Terms

EzE Air Solutions Inc. (“EzE Air Solutions,” “we,” “us,” or “our”) is committed to delivering high-quality HVAC services backed by transparent, reliable workmanship. This Warranty Page provides an overview of the limited warranty we offer on HVAC systems installed as part of new construction projects, including important limitations, conditions, and customer responsibilities.

By choosing EzE Air Solutions for your new construction HVAC installation, you acknowledge and agree to the terms of our Limited One Year Warranty as outlined below. If you have any questions or require clarification, we encourage you to contact our team directly.

1. Warranty Coverage and Term

EzE Air Solutions, Inc. (“EzE,” “we,” “our,” or “us”) hereby provides a limited warranty to the original purchaser or property owner (the “Client”) covering workmanship and labor associated with the installation of a heating, ventilation, and air conditioning (HVAC) system as part of a new construction project. This Limited One (1) Year Warranty (“Warranty”) is effective for a period of one (1) calendar year commencing on the original date of system installation, regardless of the occupancy or sale date of the property. For illustrative purposes only: if the HVAC system is installed on January 1, 2025 but the home is sold or occupied on August 1, 2025, this Warranty shall nonetheless expire on January 1, 2026.

2. Scope of Warranty

This Warranty applies exclusively to defects in EzE’s  installation practices and does not extend to equipment, parts, or components which are covered under separate manufacturer warranties.

Subject to the terms and conditions herein, EzE shall, at its sole discretion, repair or correct installation-related defects identified and reported during the Warranty period, provided that:

  • The defect arose from a failure in installation workmanship performed by EzE; and
  • The HVAC system has been properly maintained and has not been subjected to misuse, neglect, or unauthorized alteration.

No oral or implied warranties shall modify the scope or duration of this written Warranty unless set forth in a formal amendment signed by an authorized representative of EzE.

3. Exclusions from Coverage

This Warranty expressly excludes, without limitation:

  • Equipment failure caused by acts of God (e.g., hurricanes, floods, lightning strikes, volcanoes), power surges, or electrical issues outside EzE’s control.
  • Defects or malfunctions resulting from improper use, inadequate maintenance, or failure to comply with manufacturer-recommended service guidelines.
  • Normal wear and tear, such as dirty filters, drained batteries, or refrigerant loss unrelated to installation error.
  • Damages arising from structural changes, modifications to the installed system, or any unauthorized alterations.

Any repair, service, or inspection performed by an individual or company other than EzE, unless prior written authorization has been provided by EzE.

4. Servicing by Third Parties

NOTICE TO CLIENT: Engaging a third-party HVAC contractor or technician to inspect, alter, service, or repair the HVAC system during the New Install Warranty period may result in the full or partial voidance of this Warranty. EzE retains the sole discretion to determine whether third-party involvement has compromised the system in a manner that invalidates coverage.
Clients are strongly encouraged to contact EzE directly for any servicing needs within the Warranty period to avoid jeopardizing coverage

5. Client Obligations

To maintain eligibility for coverage under this Warranty, the Client agrees to the following responsibilities:

  • Maintain the HVAC system in accordance with manufacturer guidelines and specifications;
  • Promptly notify EzE of any suspected defect or performance issue in writing or by phone within the Warranty period;
  • Provide EzE reasonable access to the property during standard business hours for the purpose of inspection or repair;
  • Refrain from permitting any unauthorized third parties to modify, alter, or service the HVAC system.

Failure to comply with these obligations may result in a denial of Warranty claims.

6. Procedure for Warranty Claims

To initiate a claim under this Warranty, the Client must contact EzE Air Solutions as follows:

Clients must provide the following information:

  • Description of property/address
  • Description of the issue or concern; and
  • Any documentation or evidence supporting the claim.

All claims must be submitted within the active Warranty period. Claims submitted after the expiration of the one-year period may not be honored.

7. Limitations of Liability

This Warranty is limited to the repair or correction of installation-related workmanship defects and does not include reimbursement for consequential, incidental, or indirect damages, including but not limited to:

  • Property damage;
  • Inconvenience;
  • Loss of use;
  • Increased utility costs; or
  • Loss of profits or income.

EzE shall not be liable for any such damages, and the Client’s exclusive remedy under this Warranty is limited to the repair or correction of qualifying defects by EzE.

8. Disclaimer of Other Warranties

To the fullest extent permitted by applicable law, EzE disclaims all other express or implied warranties, including warranties of merchantability or fitness for a particular purpose, except to the extent such warranties are expressly stated in this document or required by law.

9. Governing Law and Venue

This Warranty shall be governed by and construed in accordance with the laws of the state where the equipment is installed, without regard to its conflict of law principles. Any legal action arising from or relating to this Warranty shall be brought exclusively in the appropriate state or federal court of EzE’s choosing, or at the discretion of EzE’s attorneys. 

10. Entire Agreement

This Warranty constitutes the entire agreement between EzE and the Client with respect to the subject matter herein and supersedes any prior or contemporaneous communications, representations, or agreements, whether oral or written.
